1. Acceptance of Terms
By accessing and using SunByte's lead generation services, you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service.
2. Service Description
SunByte provides lead generation services through advanced targeting algorithms, social network integration, and multi-channel advertising campaigns. Our services are designed to connect businesses with qualified prospects who meet specific criteria defined by our clients.
3. Eligibility and Account Registration
To use our services, you must:
- Be at least 18 years of age
- Have the legal authority to enter into this agreement
- Operate a legitimate business
- Complete our qualification process
- Provide accurate and complete information during registration
4. Lead Quality and Delivery
SunByte commits to delivering qualified leads that meet the criteria agreed upon during the onboarding process. A "qualified lead" is defined as a prospect who:
- Meets the demographic and psychographic criteria specified
- Has expressed genuine interest in your products or services
- Has provided valid contact information
- Has consented to be contacted for business purposes
5. Pricing and Payment Terms
Our pricing structure is based on qualified leads delivered:
- Starter Plan: $40 per qualified lead
- Professional Plan: $50 per qualified lead
- Enterprise Plan: $60 per qualified lead
- Custom plans available upon request
Payment is due within 30 days of invoice date. Late payments may incur additional fees.
6. Client Responsibilities
As a client, you agree to:
- Provide accurate information about your target audience
- Respond to leads in a timely and professional manner
- Comply with all applicable laws and regulations
- Not use leads for illegal or unethical purposes
- Maintain the confidentiality of lead information
7. Data Protection and Privacy
SunByte is committed to protecting the privacy and security of all data. We comply with applicable data protection laws and maintain strict security measures. For detailed information about our data practices, please review our Privacy Policy.
8. Intellectual Property
All content, trademarks, and intellectual property related to SunByte's services remain the exclusive property of SunByte. Clients may not reproduce, distribute, or create derivative works without explicit written permission.
9. Limitation of Liability
SunByte's liability is limited to the amount paid for services in the preceding 12 months. We are not liable for indirect, incidental, special, or consequential damages arising from the use of our services.
10. Service Availability
While we strive for 99.9% uptime, SunByte does not guarantee uninterrupted service availability. Scheduled maintenance and unforeseen technical issues may temporarily affect service delivery.
11. Termination
Either party may terminate this agreement with 30 days written notice. SunByte reserves the right to immediately terminate services for breach of terms, illegal activities, or non-payment.
12. Dispute Resolution
Any disputes arising from this agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Killeen, Texas.
13. Governing Law
This agreement is governed by the laws of the State of Texas, United States, without regard to conflict of law principles.
14. Changes to Terms
SunByte reserves the right to modify these terms at any time. Clients will be notified of significant changes via email. Continued use of services after changes constitutes acceptance of new terms.
